司法院【長期照護醫藥費列舉扣除額差別待遇案】
案 情 摘 要

我國所得稅法所定個人綜合所得稅，係以個人綜合所得總額，減除
免稅額及扣除額後之綜合所得淨額計徵之。關於扣除額，納稅義務人得
選擇標準扣除額或列舉扣除額減除之。又納稅義務人及其配偶或受扶養
親屬之醫藥費，為列舉扣除額之ㄧ。惟94.12.28 修訂之所得稅法17 條
1 項2 款2 目之3 前段規定，列舉扣除額中之醫藥費，以付與公立醫院、
公務人員保險特約醫院、勞工保險特約醫院、所，或經財政部認定其會
計記錄完備正確之醫院者為限（下稱系爭規定；其中「公務人員保險特
約醫院、勞工保險特約醫院、所」，於97.12.26 修訂為「全民健康保險
特約醫療院、所」）。
聲請人曹天民於94 年度綜合所得稅結算申報，列報受其扶養、需
長期照護親屬之醫藥費為列舉扣除額，計68 萬餘元。財政部北區國稅
局依系爭規定認其中46 萬餘元非醫療費用，亦非系爭規定所定之醫療
單位出具之收據，而予剔除；並補徵應納稅額1950 元。聲請人不服，
申請復查。復查結果追認其中2 萬餘元為上開醫療院所之特約機構所開
立，屬醫療必要費用，其餘部分仍不准扣除。聲請人不服於行政訴訟敗
訴確定後，認系爭規定限定醫藥費出具之醫療院所，有違反憲法平等原
則，聲請解釋。
大法官今日作成釋字第701 號解釋，宣告系爭規定對於身心失能
無力自理生活而需長期照護者之醫藥費，以付與上開醫療院所為限始得
列舉扣除，使付與其他合法醫療院所之醫藥費不得列舉扣除，違反憲法
平等原則；在此範圍內系爭規定應不予適用。理由：（一）系爭規定使
受長期照護者，因醫療資源分配及醫療院所分布侷限，而至其他合法醫
療院所就醫所支付之醫藥費，無法列舉扣除，影響憲法對生存權之平等
保障，應受較嚴格之審查；（二）受長期照護者因醫療所生費用，屬維
持生存必需支出，不應因其付與系爭規定以外其他合法醫療院所而有差
異；(三)系爭規定所為限制對防止浮報或規避稅負之效果並不顯著，卻
對受長期照護者之生存權有重大不利影響，不合憲法保障生存權之意
旨，是其差別待遇之手段與目的間欠缺實質關聯，不符憲法平等原則。

支付的長照費用可以比照醫療費用全部扣除以節稅，這對長照機構與院民家屬是一個好消息。

至於醫師開安養院，利潤會不會比開診所好，那就要看民眾消費力與市場競爭了。

月費1.8萬到5-6萬都有人出價，目前是自由競爭，等長照險通過後，低收費的長照機構可能變成健保特約。
