　媒體報導，近日最高法院對某一性侵害案件的判決，直指法務部違法將性侵害犯罪者執行刑後的治療，在監獄中違法進行，而非醫院；而醫院則缺乏收治的意願；法院也指出，性侵害犯罪者的治療，也缺乏個案化設計的治療計畫，應該比照先進國家的標準設置等等。法務部也澄清，「保安處分的治療行為，都應在醫院」，由於監獄不夠專業，設備亦不足，因此，並非適當場所，只是權宜之計云云。

　但是，法務部卻沒有說明，性侵害犯罪是疾病導致的行為嗎？又有多少性侵害犯罪者，是符合《精神衛生法》中所稱的精神疾病？法務部與法院推崇備至的「治療」，成效又如何？如果不是「精神疾病」，那又何來疾病治療呢？

　即令以最高法院所稱的先進國家而言，性侵害犯罪者的治療，也未必在精神科醫院中進行。以美國為例，性侵害犯罪者的強制治療，多半並非在醫院中進行，也由於不被認定為醫學上的治療行為，因此，也少有醫師參與。然而，對於將性侵害犯罪者留置在醫院中接受所謂的治療（美國稱為民事留置）一事，美國精神醫學專家小組就曾大聲疾呼，「社會對於危險性犯罪者須加以監禁及拘束的高度關切，應該透過司法刑罰系統中，量刑、處分的各種替代方式來完成，並非藉由民事上的強制留置來完成」，「這是對精神醫學無法忍受地誤用」。

　性侵害犯罪者的強制治療，一直沒有澄清一個議題：這是醫師與專業人員，面對病患的治療關係，還是國家運用醫學知識與醫學技術，面對犯罪者的行為矯治與社會控制？這是治療某種特定疾病的醫療行為，還是使用醫學知識與醫學技術，矯正犯罪者的行為？簡言之，這是司法處遇，還是醫療行為中所稱之治療？

　弔詭地是，對性侵害犯罪者的強制治療，仍有諸多爭議之時，法院判決以及司法行政單位卻如同醫學專家般地教育我們，「治療最佳場所是醫院」，「治療應個案化設計」以及治療應有如何的設備，如何的專家參與等等。就好比，法院與法務部有志一同，教導內科醫師應該如何治療糖尿病患者，何等專斷、無理與荒謬。

　對於性侵害犯罪者的犯罪預防，並不是只有行為矯治與輔導教育，還有更多應該是警政單位與法務部專業分內的犯罪防治，刑事司法處遇。美國司法部也曾明白揭示，對於性侵害的犯罪者的治療，無法脫離配套的刑事司法處遇措施，例如，社區監督、社區通告以及觀護部門的長期追蹤。

　這些犯罪防治措施，如何更具體而微地進行，卻未見諸於最高法院的判決內容，與法務部的政策宣示。我們看到的是，司法與行政單位對於性侵害犯罪者的治療，引用他們所喜好的專業意見，對醫療體系下指導棋，片面決定最合適的治療處所與治療模式。於是，之前性侵害犯罪者出獄後再犯，遭到處分的卻是醫事行政單位，遭到責難的是性侵害社區治療的體系，而法務與警政單位只有出面聲稱資訊傳遞的過程有所延誤，也再度說明人力與資源不足，卻將犯罪防治的責任推給醫事行政與社區治療系統。利用醫學知識與醫學技術，作為犯罪防治的手段，並非等同於《醫療法》所稱的醫療行為，或是等同於《精神衛生法》所規範的對於精神疾病的治療。因此，醫院當然並非適當場所。

　如果，對性侵害犯罪者的處遇，只是利用醫學知識與技術，作為犯罪防治的手段，而不是對疾病的治療，那麼，就請除去醫療行為的外衣，不要再稱之為「治療」，讓凱撒的回歸凱撒，司法處遇，就回歸司法體系吧。不要再把性侵害犯罪者的犯罪預防，當成醫療問題了。（作者為精神科醫師，任職公立精神科醫院）
