桃園縣衛生局昨天追查發現，桃園縣四家婦產科醫療院所，去年接生新生兒性別比異常，其中一家性別比高達二點三。局長劉宜廉警告，婦科醫療院所與醫師如進行性別篩檢和接生，一定依法究辦，最重可吊銷執照。

衛生署公布正常新生兒男女比率應為一點○六，桃園縣男女嬰性別比為一點○九七，超過男女嬰正常比。

劉宜廉表示，桃園縣四家性別比異常醫療院所，包括中壢市兩家、桃園一家、龍潭鄉一家，男女嬰性別比最高的一家婦產科診所，去年接生四十三名新生兒，男嬰卅人、女嬰只有十三人，男女嬰性別比達二點三最高。

他表示，一旦查獲性別篩檢或不當宣傳，可依醫師法處以十至五十萬元罰鍰，最重吊牌；另以醫療法處分違規醫院與診所，罰鍰五至廿五萬元。

全文內容：訂定「醫師執行非性聯遺傳疾病診斷所施行產前性別篩選之處置，或僅以
胎兒性別差異為由進行之人工流產等行為，為醫師法第二十八條之四第一
款規定不得從事之醫療行為」，並自即日生效。

醫師法第 28- 4 條
醫師有下列情事之一者，處新臺幣十萬元以上五十萬元以下罰鍰，得併處
限制執業範圍、停業處分一個月以上一年以下或廢止其執業執照；情節重
大者，並得廢止其醫師證書：
一、執行中央主管機關規定不得執行之醫療行為。
二、使用中央主管機關規定禁止使用之藥物。
三、聘僱或容留違反第二十八條規定之人員執行醫療業務。
四、將醫師證書、專科醫師證書租借他人使用。
五、出具與事實不符之診斷書、出生證明書、死亡證明書或死產證明書。

〔中央社〕行政院衛生署副署長江宏哲今天表示，醫師從事性別篩選違反醫師法，最高可處新台幣50萬元罰鍰，嚴重者廢除醫師證書，將儘速於2個月內調查，違者依法處理。

衛生署日前發布去年男女嬰出生比，發現部分縣市男嬰比居高，全台推估3000多女嬰遭墮胎。

中國國民黨籍立法委員賴士葆上午在立法院社會福利及衛生環境委員會質詢表示，因為要得男孩而將女嬰墮胎，衛生署是否已鎖定特定醫療院所，要如何處理？

江宏哲答詢表示，醫師若有這些行為，嚴重違反醫事倫理，會受到醫界唾棄，且性別篩選屬醫師法所規定「不得執行的醫療行為」，可處10萬元以上50萬元以下罰鍰，嚴重者更可廢除執業執照及醫師證書。

他說，「重要的是把根斬掉」，現在端出刑法，很多醫院會比較收斂；將配合衛生局，努力在2個月內查明醫院是否從事性別篩選及產男嬰比例過高原因，違法者將依法處理。

江宏哲答復國民黨籍立委鄭麗文時表示，除了對有明確違法事實的醫師、醫院開罰，衛生署也成立「性別比工作小組」進行相關調查，訂定性別篩選器材、性別檢測試劑管理辦法；也準備修優生保健法，明訂不能因性別墮胎，達到嚇阻效果。
