醫師是否納入勞基法保障？衛生署對其納入勞基法有疑慮。

（中央社記者陳偉婷台北21日電）醫師是否納入勞基法保障？行政院勞委會主委王如玄今天表示，百分百支持保障醫師勞動條件，但醫生要全面適用勞基法比較困難，半年內將與衛生署討論，讓醫師工時規定更細緻。


台灣醫療改革基金會昨天公布血汗醫院評鑑結果，點名林口長庚、台北榮總等醫院因為醫療人員不足，導致白袍勞工被壓榨，長庚護士忙到像戰鬥陀螺，榮總藥師淪為發藥機械人，多名立法委員在立法院社會福利及衛生環境委員會關心醫師、護理人員過勞狀況。


民主進步黨立法委員陳瑩質詢表示，醫師能不能納入勞基法第84條之1，在不損及健康福祉前提下，可以視狀況另行約定工作時間、休假，提升醫師勞動保障。


王如玄答詢表示，目前有651萬人納入勞基法保障，佔勞動人口96.6%，其他如家事工作服務者及醫師、律師等專業人員尚未納入，尤其醫師部分，牽涉人命問題，衛生署對其納入勞基法有疑慮。


她說，醫師值班和工時已有規定，會持續跟衛生署討論，讓規範更細緻；勞委會百分百支持保障醫師的勞動條件。


王如玄答覆民進黨立委劉建國時表示，醫生要全面適用勞基法比較困難，目前傾向先處理醫療法等相關法令及衛生署醫院評鑑指標，半年內與衛生署溝通討論，盡快處理醫師過勞問題。


此外，劉建國質詢時提問，王如玄很拚，很少跟老公吃早餐和宵夜，家庭經營不易，身為勞委會主委這麼拚，可能成為勞工榜樣，讓勞工拚命工作、甚至過勞。


王如玄答詢時表示，現階段來說，她時間有限，又希望能做更多事情，「這是個人選擇，對勞工來說是錯誤示範」，不應該這樣，但家庭並沒有問題，老公非常照顧，相處沒有問題，期盼勞工能兼顧工作和家庭。1000421
