違法侵人權 法官遭彈劾

台灣高等法院一名法官審理交通事故案件時，因為被告不肯和解，居然違法將被告當庭戴上手銬再諭令交保。監察院調查後認為，該名法官涉及侵害人權，今天通過彈劾。

監察委員李復甸、錢林慧君調查後指出，台灣高等法院法官唐照明在96年間審理一件交通事故案件時，因為被告遲遲不肯和解，為了「給被告一個警惕」，唐照明居然裁定將被告當庭戴上手銬再諭令交保，明顯違法而且違反人權。李復甸：『在這種情況下交保，當庭戴上手銬，拉到地下室去，整個程序就人權保障角度來說，是非常不妥。』

監委指出，該名被告並沒有串證、逃亡之虞，所犯的也不是五年以上的重罪，根本不符合刑事訴訟法中的「羈押要件」，既然不符羈押要件，自然也就不需要上手銬後再裁定交保。李復甸：『這個案件在不符合羈押的條件下，就逕命被告要具保，這是違反法律的規定。』

監委說，法官對於被告不肯和解，可以自行宣判，但不能以交保作為懲罰的手段，這個案件在司法界可能會認為是個小案子，但假如監察院不提出彈劾案，在司法體系官官相互、缺乏自省之下，相信日後類似侵害人權的事件還會繼續發生，因此監察院通過彈劾唐照明，希望喚起司法界對於人權的尊重。
