（中央社記者蘇龍麒台北2010年9月17日電）醫師洩漏病患病歷，未來可能面臨更重的行政處分。國民黨立委蔣乃辛提案修正醫療法，醫師未依法或未經同意洩漏病歷，將處新台幣10萬至50萬元罰鍰，是現行罰則的2倍。

依現行醫療法規定，醫師洩漏病歷可處 5萬至25萬元罰鍰。民國98年12月間，就曾發生醫師林政誠因洩漏女子孫仲瑜減重病歷，遭台北市衛生局以洩漏病人隱私、違反醫師法為由，對林政誠處10萬元罰鍰。

蔣乃辛認為，病歷是涉及病患個人身體健康與私密領域的醫療資訊，醫療人員在職務範圍內必須要保密；但是目前的罰則太輕，對醫療人員來說不痛不癢。為了落實保障病患個人隱私權益，提案修法要求醫療人員在病歷控管時，非依法或經當事人書面同意不得洩漏，違者罰則提高2倍，可處10萬元至50萬元罰鍰。

蔣乃辛提案中，也同步修法要求醫療機構應以中文建立病歷，正式將「醫療中文化」明文規定在醫療法中；但也另外規定，如果病歷資料無法確實以中文表達，得以外文加註。
