法官收賄爆案外案1離譜判決 蔡光治疑搞鬼

高院法官收賄弊案案情擴大！檢調發現在押法官蔡光治，五年前曾參與審理前花蓮高分院法官張炳龍收賄案更四審，將張炳龍由一審十二年重刑，改判無罪；由於判決理由離譜，檢調認為疑點重重，高度懷疑蔡是否居間牽線、另涉貪瀆，已展開蒐證調查。


據指出，檢調偵辦蔡光治貪瀆案，目前除鎖定何智輝銅鑼案調查，也已針對張炳龍案祕密蒐證，並已訪談多名人士調查，惟檢調基於偵查不公開，不願透露調查細節，未來若有所突破，極可能再向上發展。


張炳龍十五年前被檢舉，收受當事人郭文儒卅萬元賄款，承諾將與郭文儒打官司的蔡姓男子，從無罪改判有罪。後張炳龍未判決就被調離花蓮，郭文儒便委任律師發函，要求張炳龍還款，張才透過律師邱創舜返還本息卅七萬六千元。


台北地檢署八十五年起訴張炳龍，一、二審都判張炳龍十二年徒刑，更一、更二審減為八年，更三審則改判十年。但九十四年五月卅一日的更四審，卻大逆轉，改判無罪，直到更五審再改判十一年，經最高法院駁回上訴定讞，張炳龍判刑十一年確定後，現已入獄服刑。


檢調發現，張炳龍在歷次審理，都被認為有收賄，但更四審判決，卻指張炳龍是收到當事人索款「騷擾」信函，律師邱創舜，基於昔日同事情誼，才擅自出資幫張處理事情，因此改判張炳龍無罪。


由於更四審的認定，是將張炳龍由「收賄案被告」，硬拗成了「遭恐嚇的被害人」，判決理由相當離譜，引發輿論痛批，司法院當年快刀斬亂麻，下令當時更四審合議庭審判長房阿生，免兼高院庭長職務，房遂黯然退休。


由於當年房阿生的庭員中，陪席法官就是涉及何智輝行賄高院法官案遭羈押的蔡光治，檢調懷疑，張炳龍案更四審離譜的無罪判決，是否也有蔡光治居間牽線的情形，正進一步調查中。
