法國法庭判決商店周日不准營業

星期日通常是人們休閒逛街的日子，也是一周中消費最火、人氣最旺、商家不願錯過的時候。可是，這樣的場景在法國是不易看到的，原因在於法國《勞動法》規定，周日是法定假日，商店不得開門。如果商店營業屬非法，就有可能被告上法庭，並受到重罰。

6月14日，法國凡爾賽大事法庭作出判決，要求位於伊夫林省的“維拉庫布萊工廠商業中心”的64家服裝店停止周日營業，否則每家商店周日都將被處以1,000歐元罰款。此前，巴黎行政法院也作出了類似的判決，勒令位於香榭麗舍大街上的路易·威登精品店立即停止星期天營業，否則將受到相關法律的制裁。

然而，兩項判決都招致強力反彈。路易·威登店的總裁卡爾塞爾表示，路易·威登店“星期天營業是在得到全體工作人員同意的情況下進行的，我們不會聽任擺布，我們會為這家商店繼續星期天營業而抗爭”。巴黎市中心大商店聯合會主席佩裏亞特指出，「路易·威登（LV）是香榭麗舍大街遊客光顧最多的商店，它星期天關門對吸引遊人極為不利」。

對於凡爾賽大事法庭的判決，一個自稱為 “讓我們工作”的協會在《費加羅報》上刊登廣告說，「在一個擁有250萬失業人口、總理及其政府宣稱將就業問題作為當務之急的國家，這份判決讓人不可理解」。

關於商店是否可以在周日營業，在法國引起的爭論由來已久。贊同者認為，周日營業不僅能夠提高商店的營業額，還可為日常生活帶來便利。但反對者認為，星期天開門既侵犯了員工的休息權，也是商家搶奪市場份額的一種作弊行為。法國民調機構進行的調查顯示，將近73%的法國人支援商店星期日開門，而人們去得最多的商店是室內裝飾和自助材料店，受歡迎的還有文化、服裝和食品商店等。儘管如此，法國當局至今並不准備修改相關法規。理由是：法律規定了許多靈活之處，比如文化、旅遊等商店可以特例特辦，人們根據具體需要可以加以利用。

根據筆者在法國生活的感受，雖因維護周日休息的權利，而限制了工作的權利和享受更多服務的權利，但對於法國人來說卻沒有什么好遺憾的。因為法國人歷來崇尚休息和娛樂，節假日更是神聖不可侵犯。他們堅守這一習慣的理論依據是，《聖經》中的故事傳說告訴人們：星期日上帝也休息。

法國人一年中有好多法定休息日，除了每周5天工作制所帶來的全年104天休息外，每年還有11天假日，如元旦、“五一”、耶誕節和復活節等，外加5周帶薪年休，大約有150天之多。自1997年實施每周工作35小時，按39小時付工資的政策以來，這等於每年又無形中增加了約5周的帶薪休假。若全部加在一起，休息時間佔全年時間的40%以上，如此寬鬆的工作環境進一步強化了法國人的“浪漫情懷”。

古希臘哲學家亞裏士多德曾經說過，科學與哲學來自閒暇。這句話雖然不盡符合客觀實際，但卻成了法國人對假日文化和假日生活本質意義的詮釋之一。

以前聽過西歐國家是人權意識高漲；三色旗講自由平等博愛。真要以法律人權觀點出發：這樣的判決會不會抵觸憲法

診所上班時間太超過在咱們寶島台灣不是唯一的醫療怪現象；不管是爭取／內規週休一日或者是要捍衛全年無休 ... 這些都是衍生而來的笑話（悲痛的笑話）

點值下降；藥價江河日下診察費如山不動；哪一天要提＜週休二日＞？哪一天要提＜週休三日＞？到時恐怕還是會有人為了生存要捍衛＜週休一日＞..
