更四審認無殺人犯意


〔記者林良哲、許國楨／台中報導〕「毒蠻牛」案判決大翻盤！男子王進展將氰化物放置於「蠻牛」等飲料而造成1死3傷案，台中高分院更四審審理，推翻以往5次審理都判處其死刑的故意殺人認定基礎，認為他並無殺人之犯意，進而變更起訴法條，改判處他無期徒刑。


此判決公佈之後，引起台中法界譁然，尤其是曾偵辦起訴及蒞庭的檢察官，更是感到不可思議；台中高分檢表示將等收到判決書之後，再決定是否上訴。


94年5月，王進展向保利達公司恐嚇勒贖25萬元美金，在台中市多家超商及茶房放下11瓶摻有氰化物的「蠻牛」、「保利達B」等飲料，造成1人死亡、3人中毒，台中地檢署依殺人罪嫌將他起訴並具體求處死刑，他雖一再辯稱沒有殺人之故意，不過一審、二審到更三審的5次審理，法官都是認同檢方的起訴內容，依刑法殺人罪判他死刑。


台中高分檢還可上訴


沒想到日前在台中高分院進行更四審審理，合議庭法官認為王進展在犯案時，有採取「預防誤食措施」，刻意在瓶身上貼著寫有「我有毒 POISON 請勿喝」等標籤，認定他在主觀上並無殺人之故意，因此變更起訴法條，改以刑法「製造販賣陳列妨害衛生物品罪」，改判處無期徒刑。


對此，法界人士指出，王進展在恐嚇勒贖前，就曾經多次以動物實驗，了解多少劑量的氰化物會造成人體死亡，事後他仍在飲料中加入足以致人於死的2倍以上劑量，根本就有故意殺人之犯意。而當初偵辦該案的台中市警方認為，王進展在偵辦過程中曾出現許多「脫罪舉動」，包括明知氰化物為劇毒，又列印「我有毒、請勿喝」圖樣，且計畫從中國以電話向廠商勒贖，再以境外匯款方式取款，其殺人意圖明顯，檢方求處死刑不過分。
