（中央社記者康世人新加坡2009年5月29日專電）新加坡歌手黃湘怡在台灣開設蛋糕店，違反加盟特許經營協議，遭蛋糕專賣店在星提訴應支付罰款，但黃湘怡遲不付款，遭法院判決破產。

本案原告的蛋糕專賣店也在台灣提出類似訴訟，指控黃湘怡涉嫌違約，全案仍在法院審理中。

根據新加坡法院資料，Awfully Chocolate巧克力專賣店為特許經營授權商，黃湘怡是獲得授權的加盟商，雙方於2006年簽下特許經營協議，但隔年7月AwfullyChocolate終止這項特許經營權，並控告黃湘怡的公司違反特許經營協議。原告獲得勝訴後，要求身為擔保人的黃湘怡應支付22萬4000新元。

本案在新加坡初級法院去年裁決後，黃湘怡迄今都沒有支付款項，所以Awfully Chocolate今年1月再度對黃湘怡發出法定追債信追討欠款，黃湘怡因未按規定於收到追債信的21天內清償欠款，Awfully Chocolate於追債信發出的三個月後，在4月23日向新加坡高等法院申請黃湘怡破產。

截至當天，加上利息，這項欠款已經增加到24萬9000新元（約新台幣560萬2500元）。

新加坡高等法院於5月21日開庭審理本案，但黃湘怡委任律師以剛接下案件，希望延後審理，但遭原告委任律師反對，最後法院判決黃湘怡破產。

根據新加坡初級法院的裁決書，黃湘怡不僅要支付欠款，也須遵守特許經營協議，包括她和第三者，不得使用Awfully Chocolate的機密進行任何類似商業活動，也不能獨自或與第三者在兩年內，在台灣或其他地方成立公司，直接間接與Awfully Chocolate競爭。但黃湘怡被指控在台灣繼續從事相關生意，涉嫌違約。

黃湘怡的委任律師鄒天齊告訴「聯合早報」，今天將會向法院申請暫緩破產令執行。
