7旬老翁余文遠2007年7月因發燒、意識模糊，被送往台北市立聯合醫院中興院區急救，發現泌尿道感染併發敗血症及慢性肺癌，不料，8月2日住院治療期間，醫師鄭惠升為老翁更換導尿管後，老翁竟血尿不斷、呼吸衰竭，轉入加護病房急救。
家屬懷疑醫師錯置導尿管害老翁出血，並指控醫師未以膀胱鏡電燒止血，延誤救治，害老翁需仰賴呼吸器維生，直到2010年7月死亡，怒向醫師及院方求償508萬元看護費及精神慰撫金。
