醉漢辱罵1小時 警提告獲賠3萬

〔記者鮑建信、陳祐誠／高雄報導〕高市男子顏忠松付不出車資，被運將送到派出所，他仗著酒意，對警員藍志芳（見圖，記者陳祐誠攝）破口大罵，一罵就是一小時，因而吃上妨害公務官司，不甘受辱的藍員，另請求民事賠償，高雄地院判顏男須賠藍員3萬元。

藍志芳︰捍衛尊嚴 有利警執法

藍志芳說，基層員警常有類似困擾，長期吃悶虧，現在多已學會蒐證，捍衛個人尊嚴，相信法院這次判決，有利於警方日後執法工作。

今年3月7日凌晨4點多，旗山區男子顏忠松酒後搭計程車返家，因付不出車資，被司機載到建國派出所，委請值班警員藍志芳處理。

顏男被叫醒後，以台語「三字經」等語罵人，隨即被警方依妨害公務現行犯逮捕並上手銬；藍員製作筆錄時，顏男又用「龜兒子」、「白癡」、「婊子」、「王八蛋」等語罵人，藍員認為名譽受損，請求精神慰撫金10萬元。

面對法官詢問，顏男毫無悔意，在法庭嚼檳榔，推說自己喝醉，對經過沒印象，警方拿出蒐證錄影帶播放，證實他對員警大小聲。

顏男涉及刑案妨害公務和侮辱公務員罪，被判刑5個月，得易科罰金確定。民庭法官參酌刑事判決指出，顏男以「龜兒子」等語罵人，足以貶抑藍員人格，認定構成侵權行為，但審酌兩造社會地位和收入，賠3萬元較合理。

員警執行酒駕、路檢、巡邏等勤務，被民眾破口大罵，時有所聞，警方為維護執法尊嚴，均會追究妨害公務刑事責任。至於民事賠償，法界人士表示，員警執勤受辱，當然可提民事賠償，但有時礙於打官司麻煩，或怕被誤會欺壓百姓，絕大多數員警不願再追究民事責任。

（102年度偵字第1484號），本院判決如下：
主 文
吳O 犯公然侮辱罪，處拘役壹拾日，如易科罰金，以新臺幣壹
仟元折算壹日。
犯罪事實及理由
一、本案犯罪事實及證據，均引用檢察官聲請判決處刑書之
記載。
二、爰審酌被告吳O O並無前科紀錄，此有臺灣高等法院被告前
案紀錄表附卷可稽，僅因與告訴人C醫師之相處素來不睦，
因而產生爭執，竟不知以協調溝通方式解決，率爾辱罵對方
，使告訴人名譽受損，暨事後雖坦承上情，但仍未能徵得告
訴人之原諒等一切情狀，量處如主文所示之刑，並諭知易科
罰金之折算標準。
三、依刑事訴訟法第449條第1項前段、第3項、第454條第2項，
刑法第309條第1項、第41條第1項前段，刑法施行法第1條之
1第1項、第2項前段，逕以簡易判決處刑如主文。
如不服本判決，得於收受判決書送達後10日內，以書狀敘述理由
（須附繕本），經本庭向本院管轄第二審之合議庭提起上訴。
